Welcome to polygonlogix.com (the “Site”), operated by PolygonLogix LLC (“we,” “our,” or “us”). By accessing or using this Site, you agree to be bound by these Terms of Service (the “Terms”). “You” or “your” means you individually and, if you access or use the Site on behalf of a company or other legal entity, that entity. You represent and warrant that you have authority to bind any such entity to these Terms. If you do not agree to these Terms, please do not use the Site.

1. Use of the Site

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Site solely for lawful, internal informational and business purposes related to learning about PolygonLogix™ and communicating with us.
You may use the Site only for lawful purposes and in accordance with these Terms.
You may not attempt to gain unauthorized access to any part of the Site, its servers, accounts, databases, or any connected systems or networks.
You may not interfere with or disrupt the operation, integrity, or security of the Site, including by introducing viruses, malware, malicious code, denial-of-service activity, or other harmful technology.
You may not use any automated tools, bots, scrapers, crawlers, text or data mining tools, or similar technologies to access, monitor, copy, extract, or collect content or data from the Site without our prior written consent, including for the purpose of developing, training, or improving any artificial intelligence or machine learning system.
We may suspend, restrict, or terminate your access to the Site at any time if we believe you have violated these Terms or applicable law.

2. Intellectual Property

The Site and all content, materials, and information made available on or through the Site, including text, graphics, logos, images, videos, software, and other materials, are owned by or licensed to PolygonLogix LLC and are protected by United States and international copyright, trademark, and other intellectual property laws.
Subject to these Terms, you may view and download copies of Site materials solely for your own internal informational and business purposes in connection with evaluating or using our products or services, provided that you do not modify such materials and retain all copyright and other proprietary notices.
Except as expressly permitted in these Terms, you may not reproduce, distribute, modify, publicly display, publicly perform, transmit, publish, create derivative works from, or otherwise exploit any content from the Site without our prior written consent.
PolygonLogix™ is a trademark of PolygonLogix LLC. You may not use our name, logo, or trademarks without prior written permission.
Any rights not expressly granted in these Terms are reserved by PolygonLogix LLC.

3. Product Information and Pricing

We make reasonable efforts to ensure that product descriptions, features, availability, and pricing information on the Site are accurate. However, we do not guarantee that any information on the Site is complete, current, accurate, or error-free.
Information on the Site is provided for general informational purposes only and may be changed, updated, or removed at any time without notice.
Pricing and product availability are subject to change without notice. Any pricing or product information displayed on the Site is for informational purposes only and does not constitute a binding offer, quotation, or commitment to sell.
The purchase, download, installation, and use of PolygonLogix™ software are governed by the applicable End User License Agreement and any applicable order form, beta agreement, or other separate written agreement. In the event of a conflict, those separate agreements control with respect to the applicable software or program.

4. Beta Program

Participation in the PolygonLogix™ beta program is governed by a separate Beta Tester Agreement and any related program materials.
Beta program availability, features, functionality, and pricing are subject to change, suspension, or discontinuation at our sole discretion.
We have no obligation to make any beta feature or functionality generally available or to continue offering any beta program.

5. User Communications

If you contact us through the Site, including through a contact form, email link, demo request, or beta signup, you consent to receiving electronic communications from us related to your inquiry, account, license, support request, or other relationship with us.
Marketing communications, if any, will be sent only as permitted by applicable law and in accordance with your choices and any applicable signup preferences.
You agree that any information you submit to us through the Site will be accurate and not unlawful, misleading, infringing, or otherwise inappropriate.
Except as expressly stated in our Privacy Policy or in a separate written confidentiality agreement signed by us, any ideas, suggestions, feedback, requests, files, materials, or other information you submit to us through the Site will be deemed non-confidential and non-proprietary, and you represent that you have the right to provide such submissions.

The Site may contain links to third-party websites, services, or resources for your convenience. We do not control and are not responsible for the content, accuracy, availability, security, or practices of any third-party sites or services. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY CONTENT ON THE SITE WILL BE ACCURATE, COMPLETE, OR CURRENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLYGONLOGIX LLC, ITS AFFILIATES, AND THEIR RESPECTIVE MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, SERVICE PROVIDERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SITE OR ANY CONTENT AVAILABLE THROUGH THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Governing Law and Venue

These Terms shall be governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of laws principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the Court of Common Pleas of Lancaster County, Pennsylvania, or, if federal subject-matter jurisdiction exists, the United States District Court for the Eastern District of Pennsylvania, and each party consents to the personal jurisdiction and venue of those courts.

11. Changes to These Terms

We may update these Terms from time to time in our sole discretion. When we do, we will post the updated version on this page and revise the “Last Updated” date above. Unless otherwise stated, changes become effective when posted. Your continued use of the Site after the updated Terms are posted constitutes your acceptance of the revised Terms.

12. Site Availability

We reserve the right to modify, suspend, discontinue, or restrict all or any part of the Site at any time, with or without notice, and shall not be liable for any modification, suspension, discontinuation, or restriction of the Site.

13. Miscellaneous

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms constitute the entire agreement between you and PolygonLogix LLC regarding your use of the Site and supersede any prior or contemporaneous understandings regarding such use.
No failure or delay by us in exercising any right or remedy under these Terms shall operate as a waiver of that right or remedy.
You may not assign or transfer these Terms without our prior written consent.
Sections 2, 3, 6, 7, 8, 9, 10, 11, 12, 13, and 14, and any provisions that by their nature should survive termination or cessation of use of the Site, shall survive.
